Facts:
Following the running of Race 1, Christchurch Casino Mobile Trot, an information instigating a protest was filed by Stipendiary Steward, Mr SP Renault, against CRADDOCK (CA Butt), placed 6th by the judge and promoted to 5th, on the ground that it “broke in excess of 150 metres near the 600 metres”.
Mr CA Butt, trainer and driver of CRADDOCK, had endorsed on the information form and signed “I do not wish to be present at the hearing of this information”. Mr Renault confirmed to the hearing that Mr Butt did not wish to be present at the hearing of the information.
The official placings for the race (following disqualification of SUNNY BILL from 5th placing) were:

4th - 5 Greenanwhite
5th - 9 Craddock
Rule 870 provides as follows:
(3) Any horse which breaks from its gait shall promptly regain its proper gait.
The Breaking Horses Regulation provides as follows:
For the avoidance of doubt and in order to clarify the situation for all parties concerned, the following shall apply with regard to breaking horses:
(a) Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.
Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:
(i) relegate such horse under Rule 870 (4) to behind any other horse in respect of which an advantage may have been gained; or
(ii) disqualify it from the race under Rule 1003 (2).

Mr Renault showed a video replay of the race as the field raced down the back straight for the final time. He pointed out CRADDOCK, driven by Mr Butt, racing outside the leader, SUNNY BILL, as the field approached the 600 metres. Shortly thereafter, CRADDOCK trotted roughly and then went into a gallop, free of interference, and continued on in a gallop for a distance of approximately 160 metres. Mr Renault sought disqualification of CRADDOCK.
Reasons for Decision:
The Committee was satisfied that CRADDOCK had broken from its gait, free of interference, approximately 600 metres from the finish and had continued on in a gallop for some distance before finishing in 6th placing and being promoted to 5th. The Committee was satisfied that CRADDOCK had galloped for a distance in excess of 150 metres and had, therefore, failed to promptly regain its proper gait in breach of Rule 870(3) and the Breaking Horses Regulation.
The Committee also noted that Mr Butt did not contest the disqualification of CRADDOCK.
