Facts:
Following the running of the Coca-Cola Amatil Mobile Trot, an information instigating a protest was lodged by Chief Stipendiary Steward, Mr N Ydgren against the 2nd placing of SAY YOUR PRES on the grounds that it broke and galloped over the finishing line and was therefore in breach of the Breaking Horses Regulation.
Mr M Jones, the trainer/driver of SAY YOUR PRES, endorsed the information with the words “I do not contest or wish to be present”. Mr Jones did not appear at the hearing.
Rule 870(3) provides that “… any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869A) such relegation of the horse shall be at the discretion of the Judicial Committee".
Submissions for Decision:
Mr Ydgren demonstrated the incident by use of the race films and showed where SAY YOUR PRES broke inside the final 50 metres of the race and galloped for approximately 20 metres before crossing the finishing line.
As it crossed the finishing line the film discloses SAY YOUR PRES was lapped on by ALVIRA HEST, which finished third across the line.
Mr Ydgren submitted that SAY YOUR PRES was in breach of Rule 870(5) and should be relegated to third behind the lapped on horse.

The admission is appropriate. The video evidence is clear. SAY YOUR PRES broke approximately 20 metres from the finish and galloped across the line. It was lapped on by ALVIRA HEST. It will be relegated behind that horse to third.
