Facts:

Following the running of Race 1, The Rock Mobile Pace, an information was filed by Stipendiary Steward, Mr S Wallis, against Licensed Public Trainer, Mr T G Butt, alleging a breach of Rule 865 (2) in that Mr Butt, as the trainer of ABSOLUTE CLASSIC in the race, presented that runner in the assembly area without the correct notified gear.

Mr M D Bowden, as Mr Butt’s agent, had signed the Statement by the Defendant on the information form indicating, firstly, that the breach was admitted and, secondly, that he did not wish to be present at the hearing of the information.

Rule 865 provides as follows:
(2) Every horse entered in a totalisator race shall be presented in the assembly area prior to the race in the same notifiable gear as that notified under sub-rule (1).

 

Submissions for Decision:

Mr Wallis told the Committee that Mr Bowden was in charge of ABSOLUTE CLASSIC for Mr Butt at the meeting. Mr Bowden had presented the horse in half blinds instead of the pull down blinds that had been notified.

Mr Wallis informed the Committee that Mr Butt been fined for breaches of the Rule at Timaru on 16 December 2010 and at Winton on 11 February 2011. Pursuant to Rule 1105A (1) (3) (c), the Stewards were required to file an information rather than fine Mr Butt under the Minor Infringement System, he said.
 

Submissions for Penalty:

Mr Wallis said that, although it was Mr Butt’s third breach of the Rule since December 2010, Mr Butt’s overall record was good considering he has had 287 starters in the current season. He submitted that a fine of $100 was appropriate. This was the penalty prescribed in the Minor Infringement System for a presenting a horse in incorrect gear.

Reasons for Penalty:

The Committee was satisfied that, taking into account Mr Butt’s admission of the breach and his overall good record, that a fine of $100 was appropriate.
