Facts:
Following the running of race 2, an Information instigating a protest was filed by Stipendiary Steward, Mr P Williams, against DOWN TO THE BONE (J Dunn), placed 4th by the judge, on the grounds that it “galloped in excess of 50 metres in the final 200 metres”.
Section B of the Breaking Horses Regulations provides: that any horse which breaks in the last 200 metres of a race and continues in a break for a distance of 50 metres or greater shall be in breach of Rule 870(3).

Mr Williams showed the race video replay of the final 200 metres of the race.
Mr Williams identified DOWN TO THE BONE leading the field passing the 80-metre mark. He pointed to the horse shortly after gallop, free of interference, and continue on in a gallop for approximately 50 metres before regaining its gait short of the post, finishing in fourth place. Mr Williams showed all available angles of film at different speeds. He counted, for the Committee, DOWN TO THE BONE galloping for 3 or 4 strides prior to the 50-metre post and also counted DOWN TO THE BONE pacing for 3 or 4 strides before the winning post. He said it was extremely close to call if the horse had galloped for 50 metres.
Reasons for Decision:
The Committee carefully considered all the evidence and video footage. The Committee was satisfied DOWN TO THE BONE had galloped, free of interference, just prior to the 50-metre marker but had regained its gait and paced a full 3 strides before it reached the winning post. It was not convinced with any certainty that DOWN TO THE BONE had galloped for 50 metres or more to consider a disqualification under the Breaking Horse Regulations.
