Charge:
--Following the running of Race 2, the “Christian Fire” at Alldone Stables Dunsandel Mobile Pace, an Information was filed by Stipendiary Steward Mr S. P. Renault against Licensed Trainer Mr D. A. Taylor alleging a breach of Rule 864(2)(d). It was alleged that Mr Taylor failed to affix the front hopple carrier on “Named After Mee” (11) so as not to come adrift.

The charge reads as follows.

“I the abovenamed informant allege that the abovenamed Defendant committed a breach of Rule 864(2)(d) in that D. A. Taylor failed to affix the front hopple carrier so as not to come adrift.”

The rule reads as follows.
----
“(2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that :-
--(a) ….
--(b) ….
--(c) ….
--(d) all gear is correctly applied and/or affixed so as not to malfunction or
--come adrift.”

Facts:
--Mr Renault gave evidence as per the details set out in the Information.

Mr Taylor had indicated on the Information that this breach of the Rules was admitted, and also that he did not wish to attend the hearing.

Decision:
--As Mr Taylor had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).
----
Submissions on Penalty:
--Mr Renault made submissions that an appropriate penalty in this case was a fine of $200-00, and we were satisfied that this was in line with previous penalties imposed for a breach of this Rule.
----
Penalty:
--Accordingly Mr Taylor was fined the sum of $200-00.
