Decision:

Following the running of Race 12, the Christchurch Casino Mobile Pace, an information was filed by Chief Stipendiary Steward Mr N. R. Escott under Rules 869(4) and (6)(b) and (c) alleging a breach of the “push out” rule by Mr A. M. Butt, the driver of  THE BIG MACH (8), with about 1150 metres to run.

Following the running of Race 12, the Christchurch Casino Mobile Pace, an information was filed by Chief Stipendiary Steward Mr N. R. Escott under Rules 869(4) and (6)(b) and (c) alleging a breach of the “push out” rule by Mr A. M. Butt, the driver of  THE BIG MACH (8), with about 1150 metres to run.

Mr Butt had indicated on the Information that he admitted this breach of the Rules and he confirmed this at the hearing.  Mr Butt also agreed that he understood the charge and the Rule it was brought under.

Mr Escott gave evidence and used video coverage to show that with about 1150 metres to run Mr L. O’Reilly (BUSHFIRE) was making a forward move when Mr Butt moved out in front of him, making Mr O’Reilly race four wide.

Mr Butt gave evidence that his horse was a fraction late coming out, and that this was the cause of the incident.

In relation to penalty Mr Escott advised that Mr Butt had no previous relevant convictions, and as he had admitted the breach a fine of $200-00 was recommended.  Mr Butt agreed that the amount of the fine recommended was fair.

We were satisfied that a fine of $200-00 was appropriate in this case, and Mr Butt was therefore fined the sum of $200-00.
