Following the running of Race 9, the Searells Chartered Accountants Pace, an information was filed by Stipendiary Steward Mr N. G. McIntyre against Mr P. A. Kay, Licensed Trainer of “Madam Phoenix” (7), alleging a breach of Rule 864(2)(d) in that this horse was presented to race with shoes that were in poor condition.
Following the running of Race 9, the Searells Chartered Accountants Pace, an information was filed by Stipendiary Steward Mr N. G. McIntyre against Mr P. A. Kay, Licensed Trainer of “Madam Phoenix” (7), alleging a breach of Rule 864(2)(d) in that this horse was presented to race with shoes that were in poor condition.
Mr Kay had indicated on the information that he admitted this breach of the Rules and that he did not wish to attend the hearing.
Mr McIntyre gave evidence that prior to the running of Race 9 it was noticed that the rear shoes on “Madam Phoenix” were in poor condition. It was necessary to remove these shoes before the start of the race.
--In relation to penalty Mr McIntyre advised that Mr Kay had no previous relevant convictions, and a fine of $100-00 was recommended.
--We were satisfied that a fine of $100-00 was appropriate in this case, and accordingly Mr Kay was fined the sum of $100-00.
