The protest was upheld and CELTICLANDZ was disqualified from the race. Consequent upon the relegation, the amended result of the race is as follows:

1st 6 Tatijana Bromac
2nd 7 Artzone
3rd 12 Charger
4th 13 Earsgrinning At You
5th 10 Roy Bolt

It was ordered that dividends and stakes be paid in accordance with that amended result.

Facts:

Following the running of Race 4, SNAE (Bahco Tools) Mobile Pace, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against CELTICLANDZ (C J De Filippi), placed 4th by the judge, on the ground of a breach of Rule 869 (7B) (moving inside the marker line in the last 600 metres of the race).

Mr De Filippi had endorsed and signed the information form “I do not contest the protest”.

Rule 869 provides as follows:
(7B) Where any horse or its sulky wheel moves inside the track marker line for more than 30 metres in the last 600 metres of a race the horse shall be disqualified from that race except where it is established that the breach was caused by interference by another horse or horseman.

Submissions for Decision:

Mrs K R Williams, Stipendiary Steward, showed video replays of the final 600 metres of the race. She pointed out CELTICLANDZ, driven by Mr De Filippi, racing 3-back on the pylons as the field left the back straight with approximately 450 metres to run. She then showed the left-side sulky wheel of the horse go inside a number of track markers, for a distance of 70-80 metres she alleged. The encroachment was clearly visible from the video replays.

There was no evidence of any interference in terms of the Rule.

Reasons for Decision:

The Committee was satisfied that the sulky wheel of CELTICLANDZ had moved inside the track marker line (as defined by the pylons) for, clearly, a distance of more than 30 metres on the last 600 metres of the race. It was also noted that Mr De Filippi, the driver of CELTICLANDZ, did not contest the protest.
