The protest was upheld and LIGHTWORKOFIT was disqualified. Consequent upon the disqualification, the amended result is as follows:

It was ordered that dividends and stakes be paid in accordance with that amended result.

Facts:

Following the running of Race 2, Lindauer Supports Addington’s Ladies Night Mobile Trot, an information instigating a protest was filed by Stipendiary Steward, Mr S W Wallis, against LIGHTWORKOFIT (D G Burrows), placed 3rd by the judge, on the ground that it “broke in excess of 50 metres in the home straight”.

Mr Burrows, Part-Owner, Trainer and Driver of LIGHTWORKOFIT, was present at the hearing of the information representing the connections of that horse.

The official placings were:

Rule 870 provides as follows:

(3) Any horse which breaks from its gait shall promptly regain its proper gait.

The Breaking Horses Regulation provides as follows:

For the avoidance of doubt and in order to clarify the situation for all parties concerned, the following shall apply with regard to breaking horses:

(b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:

(i) relegate such horse under Rule 870 (4) to behind any other horse in respect of which an advantage may have been gained; or

(ii) disqualify it from the race under Rule 1003 (2).

Submissions for Decision:

Mr Wallis showed a video replay of the final 200 metres of the race. He pointed out LIGHTWORKOFIT, driven by Mr Burrows, leading the field inside the final 200 metres when it went into a gallop.

Mr Wallis alleged that LIGHTWORKOFIT had galloped for a distance of approximately 60 metres inside the final 200 metres of the race. He referred, in particular, to the marker on the inside of the track indicating the point 50 metres from the finishing line. He alleged that, although LIGHWORKOFIT had settled back into a trot prior to the finishing line, the distance over which it had galloped was in excess of 50 metres. Mr Wallis sought disqualification of LIGHTWORKOFIT.

Mr Burrows told the Committee that, after having viewed the video replay, he accepted that LIGHTWORKOFIT had galloped for a distance greater than 50 metres. 

Reasons for Decision:

The Committee was satisfied that LIGHTWORKOFIT, when leading inside the final 200 metres of the race, broke from its gait, free of interference, and continued on in a gallop for a distance of 50 metres or greater, before settling back into its correct gait prior to the finishing line, finishing in 2nd placing. It was, therefore, in breach of Rule 870 (3) in that it had failed to promptly regain its proper gait.
