The Protest is upheld, and ONE OVER DA STARS is disqualified. The amended placings are:

1st-(6)-WEE MAN TROUBLE
2nd-(1)-SUGAR CANE
3rd-(3)-MONRIKA
4th-(5)-NEVERNEVERLAND
5th-(2)-RACHMANINOV

An order for dividends and stakes to be paid in accordance with the amended placings was also given.

Facts:

Following Race 1 (LAMB & HAYWARD MOBILE TROT 1980m) Information A10891 was filed with the Judical Committee. It alleged that ONE OVER DA STARS breached the provisions of Rule 870(3) and the Breaking Horses Regulation in that it “galloped over an excessive distance in the home straight”.

Rule 870(3) states: “Any horse which breaks from its gait shall promptly regain its proper gait”.

The relevant Breaking Horses Regulation states: “(b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to regain its proper gait”.

The provisional placings were:

1st-(6)-WEE MAN TROUBLE
2nd -(10)-ONE OVER DA STARS
3rd-(1)-SUGAR CANE
4th-(3)-MONRIKA
5th-(5)-NEVERNEVERLAND

Submissions for Decision:

Using the side-on and head-on films, Mr Renault identified ONE OVER DA STARS racing in second position as it approached the yellow 50m marker located on the inside of the track. He alleged that the horse had gone into a gallop shortly before the 50m marker and had returned to a trot after the finish line. He submitted that as other runners had been compliant with the Breaking Horses Regulation, it was appropriate for the horse to be disqualified.

Mr May disputed that his horse had gone into a gallop prior to the final 50 metres. Using the side-on film he drew the Committee’s attention to the 50m marker located on the outside of the track and submitted that his horse’s front leg had gone into a gallop “right on the 50 metres”.

Mr Renault advised that the Regulation specified that a break within the final 200 metres for a distance of 50 metres or greater applied, but if the Committee determined that the horse broke within that distance, then the Lapped On Rule would still apply.

Reasons for Decision:

The Committee considered all of the submissions placed before it. The head-on film clearly establishes when Mr May’s horse went into a gallop. When this is synchronised with the side-on view which identifies both the inside and outside markers, we are satisfied that ONE OVER DA STARS is in breach of the Rule and the relevant Breaking Horses Regulation. It is also clear that the continuation of the break is for a distance of at least 50 metres. In our assessment, at the point of the 50 metres mark, ONE OVER DA STARS is not in it’s correct gait, and it remains in an incorrect gait until the winning post. Accordingly it is appropriate for it to be disqualified.
