DECISION AND REASONS:

Following the running of Race 4, Nevele R Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Horseman, Mr S J Thompson alleging that Mr Thompson "drove carelessly when allowing his horse ONE NIGHT IN PARIS to contact another sulky in the run home causing his horse to break".

Mr Thompson was present at the hearing of the information and admitted the breach. He was assisted at the hearing by Licensed Open Driver, Mr M P Jones.

Mr Ydgren stated that, rounding the turn, Mr Thompson while looking for a run Mr Thompson reached down to activate the pull-down blinds and, at the same time, struck the sulky of B GRUDGE (C J De Filippi). Mr Ydgren submitted that Mr Thompson had fallen below the expected standard of a prudent horseman.

Mr N G McIntyre, Stipendiary Steward, showed video replays of the incident.

Mr Jones submitted, as a mitigating factor, that Mr Thompson was outside the wheel of Mr De Filippi and that there was an outward movement by Mr De Filippi and that, without that outward movement, there would have been no contact. The contact was not with the back of Mr De Filippi's sulky, Mr Jones submitted.

Mr Ydgren stated that, just prior to the contact, the main movement had come from Mr Thompson back down onto Mr De Filippi's sulky. Any movement from Mr De Filippi was minimal, Mr Ydgren submitted. The Committee agreed that any movement from Mr De Filippi was minimal and, further, was of the view that Mr De Filippi had not contributed to the incident which was caused by the careless driving of Mr Thompson as was acknowledged by him in admitting the breach.

Mr Ydgren referred to Mr Thompson's good driving record (no breaches within the past 12 months) and his admission of the breach. He recommended a fine of $200.

The Committee considered that the recommended penalty was appropriate for the particular breach in all the circumstances, including Mr Thompson's admission of the breach and his good record, and Mr Thompson was fined the sum of $200.
