Facts:
Following the running of Race 9, the Canterbury Standardbred Breeders Stakes, an Information was filed by Stipendiary Steward Mr N. G. McIntyre against Junior Horsewoman Miss A. D. Edmonds alleging a breach of Rule 869(2)(a) in that she used her whip excessively.
The charge reads as follows:
“I the above named informant allege that the above named Respondent committed a breach of Rule 869(2)(a) (in that) Miss Edmonds used her whip to excess on her drive FLYOVER”.
Rule 869(2)(a) reads as follows:
“(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.”
Miss Edmonds is a Junior Horsewoman, and she was assisted at this hearing by Open Horseman Mr D. J. Butt. Miss Edmonds had indicated on the Information that this breach of the Rules was admitted, and she confirmed this at the hearing. Miss Edmonds also agreed that she understood the charge and the Rule it was brought under.
Submissions for Decision:
Mr McIntyre gave evidence and used video coverage to show that Miss Edmonds had used her whip on 20 or 21 occasions in the run home. Although the use was not continuous it was “too much”.
Mr Butt said that Miss Edmonds was trying to get the best out of her horse which was in contention all the way down the straight. It was seen that Miss Edmonds stopped using her whip short of the finish when it became clear that she could not beat the first two horses.
Reasons for Decision:
As Miss Edmonds had admitted the breach it was found to be proved in accordance with Rule 1111(1)(d).
Submissions for Penalty:
In relation to penalty Mr McIntyre advised that Miss Edmonds had two previous relevant breaches of this Rule on 10 December 2011 and 1 April 2012, being fined the sum of $200-00 on each occasion. Miss Edmonds had 16 drives last season and has had 40 drives so far this season. Miss Edmonds said that she would prefer a fine to a suspension. Mr McIntyre submitted that a fine of between $250-00 and $300-00 should be imposed in this case.
Miss Edmonds had no relevant submission to make with regard to penalty.
We adjourned to consider the matter of penalty.

We took into account Miss Edmonds’ admission of this breach, but also that this is her third breach in the last 4 months. We assessed this breach to be at the lower end of the scale, and also took into account that Miss Edmonds is a Junior Horsewoman who does not have a lot of drives.
Taking all these matters into account we decided that a fine of $300-00 would be imposed in this case.
