DECISION AND REASONS:
--Following the running of Race 7, the Ravenscar Farm Pace, Chief Stipendiary Steward Mr N. R. Escott laid an information alleging that Mr J. R. Dunn, the driver of "Mystic River" (11), committed a breach of Rule 869(2)(a) in that he used his whip excessively. The charge reads as follows.
------"I the above named informant allege that the above named Defendant committed a breach of Rule 869(2)(a) in that J. Dunn used his whip in an excessive manner in the run home whilst driving Mystic River."
--Rule 869(2)(a), so far as it relates to the present charge, reads as follows.
--"(2) No horseman shall during any race:-

- use his whip in an ?. excessive ?.manner."

Mr Dunn had indicated on the information that he did not admit this
--Breach of the Rules, and he confirmed this at the hearing Mr Dunn also agreed that he understood the Rule and the charge, and he also agreed that he was conversant with the "Use of the Whip" guidelines.
--Stipendiary Steward Mr Williams used video coverage to show that in the straight Mr Dunn used his whip on 22 ? 24 occasions, and that there was no respite in this use. Mr Dunn's horse, "Mystic River" had won the race.
--Mr Dunn did not dispute the video coverage of the race, but explained that he had not been hitting the horse on all the occasions he had used the whip, having hit the sulky shaft on most occasions. Mr Dunn acknowledged that the whip guidelines made no distinction between hitting the horse, harness or sulky.
--We adjourned to consider our decision. On returning to the Enquiry Room we advised the parties that we were satisfied that Mr Dunn had used his whip on about 25 occasions in the straight, and we found the charge proved.
--Penalty: Mr Escott informed the Committee that Mr Dunn had a previous conviction under this Rule on 20 August 2006. A fine of $250-00 was recommended.
--Mr Dunn did not dispute that the $250-00 fine was appropriate and he was fined this amount.
