Following the running of Race 6 an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr P. C. Nairn alleging a breach of Rule 867 in that Mr Nairn drove "Shirley Temple" for almost the length of the straight on the final occasion with his right foot out of the sulky foot rest

DECISION AND REASONS:

Following the running of Race 6 an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr P. C. Nairn alleging a breach of Rule 867 in that Mr Nairn drove "Shirley Temple" for almost the length of the straight on the final occasion with his right foot out of the sulky foot rest. Mr Nairn had indicated on the Information that he admitted the breach of this rule and that he did not wish to attend the hearing. Mr Nairn also endorsed on the Inforfmation that he preferred a suspension to a fine.

Mr Escott showed video coverage of this incident.

Mr Escott also advised the Committee that Mr Nairn had admitted a breach of this same Rule on 30 March 2007 when he had been fined the sum of $150-00. Mr Escott also said that a fine of $300-00 would have been appropriate for this breach, but that taking into account Mr Nairn's guilty plea and his preference for a suspension, he recommended a three day suspension from the end of racing tonight until after the end of racing on 18 April 2007.

PENALTY: After considering the matter of penalty we were satisfied that a three day suspension was appropriate. Accordingly Mr Nairn's open horseman's licence was suspended from after the completion of racing on 7 April 2007 until after the completion of racing on 18 April, which is a three day suspension.
