Following the running of Race 11, the Michael Stratford Property Devopments Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R Escott against Mr B. J. Lilley, the trainer of Gridlock" (3), alleging a breach of Rule 864(2)(d).

DECISION AND REASONS:
--Following the running of Race 11, the Michael Stratford Property Devopments Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R Escott against Mr B. J. Lilley, the trainer of Gridlock" (3), alleging a breach of Rule 864(2)(d).
--The charge reads as follows.
------"I the above named informant allege that the above named Defendant committed a breach of Rule 864(2)(d) in that Mr Lilley presented and raced Gridlock with the neck band not properly affixed as required under the Rules (refer to the "Approved Gear" Regulation) when racing in a Quick Hitch cart."
--Rule 864(2)(d) reads as follows.
--"(2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-
--- ------
- All gear is correctly applied and/or affixed so as not to malfunction or come adrift."

Clause 45 of the "Approved Gear" Regulation provides as follows.
--"45. Quick Hitch Harness ? where horses have Quick Hitch sulkies
--attached, a neck strap must be worn to secure the reins."
--Mr Lilley had indicated on the information that he admitted this breach of the Rules and he confirmed that at the hearing.
--Mr Escott informed the Committee that the Rules require that a neck band be worn where a Quick Hitch sulky is used. On 23 March 2007 Mr Lilley was warned for not using a neck band. On 30 March 2007 it was again found that Mr Lilley had not used a neck band, and he was charged with this breach of the Rules. The charge was heard at Motukarara on 1 April 2007 when Mr Lilley admitted the breach and was fined $200-00.
--In tonight's race it was found that Mr Lilley had used a neck strap on "Gridlock", but that the near side rein was not through this neck strap. Mr Escott also said that it was unacceptable that Mr Lilley took no heed of instructions given to him by the Stipendiary Stewards.
--Mr Lilley said that he used a rein pricker on "Gridlock" and that he had problems when the neck strap was used. He said that he was doing his best to see that the horse did not break in its races, and the use of the neck band was not helping.
--In response to this Mr Escott said that other trainers had the same problems and were able to overcome them. The Rules were clear and Mr Lilley would have to adjust to comply with them.
--PENALTY: Mr Escott recommended a fine of $400-00 in this case as the breach had followed so soon after the previous breach. Mr Lilley repeated that he was doing his best to have "Gridlock" race competitively.
--We adjourned to consider the matter of penalty. In considering an appropriate penalty we took into account that Mr Lilley had been quite blatant in not complying with this Rule. A fine of $400-00 was appropriate in the circumstances, and Mr Lilley was fined this amount.
--At the conclusion of this hearing Mr Lilley was warned that further non-compliance with this Rule would result in a much heavier penalty.
