DECISION AND REASONS:
----
Following the running of Race 9, the Livingstone First National Pace, an information was laid by Stipendiary Steward Mr N. Ydgren against Mrs A. Tomlinson, the driver of ?Credo? (10), alleging a breach of the ?push out? rule.
----
Mrs Tomlinson had indicated on the information that she did not admit this breach of the rules, but after seeing the video coverage of the incident again she changed her plea and admitted the breach. A video of the incident was shown where Mrs Tomlinson had pushed ?Three Of A Kind?, driven by Mr C. J. De Filippi, wider on the track at about the 1200m mark.
----
PENALTY: Mr Ydgren advised that Mrs Tomlinson had no previous relevant convictions. A fine of $200-00 was recommended. Mrs Tomlinson had no relevant submissions to make regarding penalty and we were satisfied that a fine of $200-00 was appropriate. Mrs Tomlinson was fined the sum of $200-00.
