DECISION AND REASONS:
--Following the running of Race 2, World Driving Championship Heat Mobile Trot, an information was filed by Chief Stipendiary Steward, Mr N R Escott, instigating a protest against THE GREAT PRETENDER (Veiko Tamjarv), placed 2nd by the judge, on the grounds of breaking from its gait and being lapped on by MOTU SHEER DELIGHT (C J De Filippi), placed 3rd by the judge.
----The trainer of THE GREAT PRETENDER, Mr W G Cochrane, was present at the hearing of the information, along with two of the part-owners of the horse. Mr Tamjarv, from Estonia, was also present and was assisted by Licensed Open Horseman, Mr A M Butt.
----Mr Butt informed the Committee that he had explained the "lapped on Rule" to Mr Tamjarv.
----Mr Escott showed a video replay of the concluding stages of the Race. He pointed out THE GREAT PRETENDER break from its gait some 10-15 metres before the finish and continue in a gallop, being in a gallop when its nose reached the finishing line. Mr Escott also showed a photo finish of the Race which showed THE GREAT PRETENDER in a gallop when its nose reached the finishing line. The official margin between 2nd and 3rd at the finish was a long neck and THE GREAT PRETENDER was clearly lapped on by the 3rd horse, MOTU SHEER DELIGHT.
----The protest was not contested by the connections of THE GREAT PRETENDER or by Mr Butt on behalf of Mr Tamjarv.
----The Committee was satisfied that THE GREAT PRETENDER was not in its correct gait when its nose reached the finishing line and that it was lapped on by the 3rd horse, MOTU SHEER DELIGHT.
----Accordingly, the protest was upheld and THE GREAT PRETENDER was relegated from 2nd to 3rd placing and MOTU SHEER DELIGHT was promoted from 3rd to 2nd placing.
----Consequent upon the relegation, the amended placings for the Race are as follows:
--1st 13 With Intent
--2nd 8 Motu Sheer Delight
--3rd 3 The Great Pretender
--4th 9 Shara Boy
--5th 2 Gladys Emanuel
