Following the running of Race 1, The Southern Trust Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr M. P. Edmonds, the driver of Judys A Flyin (3), alleging that Mr Edmonds had committed a breach of Rule 869(2)(a) in that he used his whip excessively

DECISION AND REASONS:

Following the running of Race 1, The Southern Trust Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr M. P. Edmonds, the driver of Judys A Flyin (3), alleging that Mr Edmonds had committed a breach of Rule 869(2)(a) in that he used his whip excessively over the concluding stages.

Mr Edmonds had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing.

Mr Escott used video coverage of the final stages of the race showing that Mr Edmonds had used the whip on about 27 occasions in the straight. Mr Edmonds agreed that the use of the whip was excessive and said that although it looked bad, he had used the whip mainly on the sulky shaft. Mr Edmonds agreed that this did not make the breach any less serious.

Penalty: Mr Escott advised that it should be taken into account that Mr Edmonds had admitted this breach of the Rules, but it was also relevant that he had a previous conviction for the same offence on 9 April 2006. It was recommended that a fine of $400-00 would be appropriate, or a suspension for two days.

Mr Edmonds confirmed the previous breach, and said that he would prefer a fine to a suspension. I was satisfied that a fine of $400-00 was appropriate for a second breach of this Rule within the last 3 months, and Mr Edmonds was fined the sum of $400-00.

Mr Edmonds was also cautioned that a further breach of this Rule in the near future would almost certainly result in a suspension of his horseman's licence.
