DECISION AND REASONS:
--Following the running of Race 10, 123racing.com Mobile Pace, an information instigating a protest was filed by Stipendiary Steward, Mr N G McIntyre, against LOYAL VALE (G P Gillard), placed 1st by the judge, on the grounds of interference to HARD HELD (S J Thompson), placed 11th by the judge, after 100 metres.
----Mr Gillard indicated to the Committee that he was authorised to represent the connections of LOYAL VALE.
----Mr Thompson said that, shortly after the start of the Race, the horse in front, LOYAL VALE, "galloped slightly for a couple of strides" before settling back down. Mr Thompson further stated that his horse was "travelling very keenly". He had to take hold of his horse and ran into the back of LOYAL VALE.
----Mr N M Ydgren, Stipendiary Steward, showed video replays of the incident. He pointed out LOYAL VALE drawn 1 at the 1950 metre mobile start with HARD HELD directly on its back, having drawn 1 on the second line. LOYAL VALE began to pace roughly shortly after the start and broke. HARD HELD was checked and broke, losing all chance. At the time, HARD HELD was racing slightly off the back of LOYAL VALE, Mr Ydgren said.
----Mr Gillard said that after the false start, his horse had got squeezed up and had cut its leg badly. It did not usually pace roughly out of the gate. He believed that the cut had affected its gait. Mr Gillard admitted that HARD HELD had received interference but stated that HARD HELD had been racing keenly. Mr Gillard declined the opportunity to say anything further.
----Mr McIntyre, in summing up, said that interference had clearly occurred. Although Mr Thompson said that his horse was overracing, it was racing clear of LOYAL VALE at the time that horse paced roughly. Mr Thompson had to take a hold of his horse and its chances were extinguished. Had LOYAL VALE kept pacing, no interference would have occurred.
----The Committee considered all of the evidence including the video evidence. The Committee was satisfied that, when LOYAL VALE paced roughly/broke just after the start, it did interfere with the progress or chance of HARD HELD, which was racing in its correct position, immediately behind it. It was clear from the evidence that the chances of HARD HELD were affected as a result of that interference ? HARD HELD was checked and broke badly losing all chance in the Race. The Committee had a discretion whether or not to relegate LOYAL VALE. The Committee was satisfied that LOYAL VALE should be relegated behind HARD HELD in the circumstances having regard to the effect of the interference on the chances of HARD HELD in the Race. The interference took place just after the start and HARD HELD was, effectively, denied the opportunity of competing in the Race when the interference resulted in its breaking and losing a big stretch of ground.
----Accordingly, the protest was upheld and LOYAL VALE was relegated to 11th placing. As a consequence of the relegation, the amended placings for the Race are as follows:

--2nd 14 Elrae Night
--3rd 6 Italian Lass
--4th 1 Palmer
--5th 16 Artic Trickster
