DECISION AND REASONS:

Following the running of Race 9, Lindauer Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Junior Driver, Ms A D Edmonds, alleging that Ms Edmonds, as the driver of FRANCO AMITY in the Race, “drove carelessly when allowing her horse to strike the sulky of the horse in front causing the horse she was driving to break and lose all chance”.

Ms Edmonds was present at the hearing of the information where she was assisted by Mr A M Butt, Licensed Open Driver. She denied the breach of the Rule.

Mr N M Ydgren, Stipendiary Steward, showed video replays of the incident which took place with approximately 1300 metres to run in the 2600 metres event.  He pointed out FRANCO AMITY racing 5-back on the markers behind DANIEL ALLAN (S F Smolenski). At that point, Ms Edmonds reached down and pulled the hopple-shorteners and ran up, struck the rear of Mr Smolenski’s sulky and her horse broke.

There had been a “slight slackening of the pace”, Mr Escott alleged, but he asked the Committee to note the speed at which Ms Edmonds was travelling. Ms Edmonds had earlier told the Stipendiary Stewards that she was having trouble with her horse, Mr Escott said, but nevertheless elected to pull the shorteners at that time. Ms Edmonds was going at such a pace that she was unable to control her horse to avoid it hitting the sulky of the horse in front. He had Mr Ydgren point out the slackening of the pace on video replay.

Mr Butt asked Ms Edmonds whether her horse had struck the sulky of the horse in front. She replied that, to the best of her knowledge, it had not.  Mr Butt then asked Mr Ydgren what he had asked Mr Smolenski. Mr Ydgren replied that he had only asked Mr Smolenski if he had received a flat tyre to which Mr Smolenski had replied no.

Mr Butt said that he had spoken to Mr Smolenski, who was on his way home, who told him that he had not been “touched or hit from behind”. Mr Butt requested if it would be possible to contact Mr Smolenski by phone. Mr Escott consented to this course of action. Mr Smolenski was duly contacted and told the hearing, over speakerphone, that he had not received any contact from Ms Edmonds in the incident to which the charge related.

At this point, Mr Escott sought leave to withdraw the charge in the light of Mr Smolenski’s evidence. The charge was withdrawn by leave of the Committee.
