Decision:
Following the running of Race 1, Cadbury Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Mr S P Walkinshaw, alleging that Mr Walkinshaw, as the driver of JOYS UNDERWORLD in the Race, “forced NIGEL PAUL driven by B Orange wider on the track prior to the 1000 metres point” in breach of the “push-out Rule”.
DECISION AND REASONS:
--Following the running of Race 1, Cadbury Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Mr S P Walkinshaw, alleging that Mr Walkinshaw, as the driver of JOYS UNDERWORLD in the Race, “forced NIGEL PAUL driven by B Orange wider on the track prior to the 1000 metres point” in breach of the “push-out Rule”.

Mr Walkinshaw was present at the hearing of the information and admitted the breach which, accordingly, was found proved.

Mr Ydgren showed a video replay of the relevant part of the Race. He pointed out JOYS UNDERWORLD racing 3-back on the outside. He then pointed out HARPER ROAD (G D O’Reilly), which had been racing second-last in the ten-horse field commence to improve with NIGEL PAUL (B N Orange) on his back. After HARPER ROAD had got past JOYS UNDERWORLD, Mr Walkinshaw moved that latter runner out onto the back of HARPER ROAD and forced NIGEL PAUL, which was progressing forward, to race 4-wide. This took place with approximately 1300 metres to race. Mr Ydgren stated that JOYS UNDERWORLD had been “racing keenly” but Mr Walkinshaw had had in excess of 200 metres to decide to come out but had left it until HARPER ROAD had gone past to do so.

Mr Ydgren informed that Mr Walkinshaw had a clear record. He recommended a fine of $200.

Mr Walkinshaw acknowledged that it was a clear case of a breach of the “push-out Rule” and had no submission to make in relation to penalty.

Having regard to Mr Walkinshaw’s good record and his admission of the breach, he was fined the sum of $200.
