Following the running of Race 6, the Nevele R Fillies Series (Heat 8), an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr M. P. Jones, the driver of “Shesachristian” (11), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively.  



DECISION AND REASONS:

          Following the running of Race 6, the Nevele R Fillies Series (Heat 8), an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr M. P. Jones, the driver of “Shesachristian” (11), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively.

Mr Jones had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing.  Mr Jones also agreed that he understood the Rule and the nature of the charge.

Video coverage of the later stages of the race were shown, and evidence was given that Mr Jones had used his whip on about 21 occasions.  Mr Jones said that he thought the breach of the Rule was “borderline”.

Penalty:

          In relation to penalty Mr Escott said that Mr Jones had no previous convictions under this Rule in the last 12 months, and as he is a very busy driver this is an excellent record.  Mr Escott said that a fine of between $200-00 and $250-00 would be the normal range for a fine.  As this was a $20,000-00 race on a Premier night Mr Escott recommended a fine of $300-00.

          We adjourned to consider the matter of penalty.  We considered that a fine of $300-00 was the appropriate starting point taking into consideration the stake payable in this race.  We took into account Mr Jones’ admission of the breach and his excellent record.  For these reasons we decided that a fine of $250-00 was appropriate in this case.

          Mr Jones had advised that he would not attend the hearing for the penalty decision, and on returning to the Enquiry Room we advised the Stipendiary Stewards of our decision to impose a fine of $250-00.
