Following the running of Race 11, the Canterbury Aluminium Mobile Pace, an information was laid by Stipendiary Steward Mr N. M. Ydgren against Mr J. L. Noakes, the driver of “Glengarry Sunrise” (9), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip unnecessarily by constantly striking an obviously beaten runner.

Following the running of Race 11, the Canterbury Aluminium Mobile Pace, an information was laid by Stipendiary Steward Mr N. M. Ydgren against Mr J. L. Noakes, the driver of “Glengarry Sunrise” (9), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip unnecessarily by constantly striking an obviously beaten runner.

Mr Noakes is a Junior Horseman, but advised that he did not wish to have the assistance of a senior horseman. Mr Noakes had indicated on the information that he admitted this breach of the Rules, and he confirmed this at the hearing. He also agreed that he understood the charge and the Rule it was laid under. Mr Noakes also agreed that he was familiar with the “Use of the Whip” guidelines.

Mr Ydgren used video coverage to show this incident, which entailed Mr Noakes using his whip on a number of occasions in the run home, at which time his horse was at the rear of the field. It was also clear that his horse had no chance of improving its position. “Glengarry Sunrise” finished last.

Mr Noakes said that his actions were “silly”.

Mr Ydgren advised that Mr Noakes had no previous relevant convictions. The choice of a fine or a suspension was discussed with Mr Noakes, and he said that he preferred a fine. A fine of $200-00 was recommended, and Mr Noakes had no relevant submissions to make relating to penalty.

I was satisfied that a fine of $200-00 was appropriate in this case and accordingly Mr Noakes was fined the sum of $200-00.
