Decision:
Following the running of Race 9, the Purchase Your Lindauer Lawn Tickets Now Handicap Trot, an information was filed by Chief Stipendiary Steward Mr N. R. Escott under Rules 869(4) and (6)(b) and (c) alleging a breach of the push out rule by Mr M. R. Hay, the driver of “Mon Star” (13), with about 1100 metres to run.
Following the running of Race 9, the Purchase Your Lindauer Lawn Tickets Now Handicap Trot, an information was filed by Chief Stipendiary Steward Mr N. R. Escott under Rules 869(4) and (6)(b) and (c) alleging a breach of the push out rule by Mr M. R. Hay, the driver of “Mon Star” (13), with about 1100 metres to run.
--Mr Hay had endorsed the Information that he admitted this breach of the Rules and that he did not wish to attend the hearing. The charge was found to be proved accordingly.
--Mr Escott used video coverage to show that with about 1100 metres to run Mr Hay had moved outwards, and in doing so had pushed “Miss Warbucks” (11), driven by Mr R. H. Jenkins, four wide.
--Penalty:
--In relation to penalty Mr Escott advised that Mr Hay had no previous relevant convictions and a fine of $200-00 was recommended. We were satisfied that a fine of $200-00 was appropriate, and Mr Hay was therefore fined the sum of $200-00.
