Following the running of Race 2, the Vero Insurance Trot, an Information Instigating a Protest was filed by Stipendiary Steward Mr N. G. McIntyre alleging a breach of Rule 870(3) and the “Breaking Horses” Regulations.  The information reads as follows.

Following the running of Race 2, the Vero Insurance Trot, an Information Instigating a Protest was filed by Stipendiary Steward Mr N. G. McIntyre alleging a breach of Rule 870(3) and the “Breaking Horses” Regulations.  The information reads as follows.

“This is a protest against horse number (4) placed 4th by the judge on the grounds of breaking from its gait (Rule 870 and the “Breaking Horses” Regulations) over the initial stages.”

Rule 870(3) reads as follows.

--

“(3) Any horse which breaks from its gait shall promptly regain its gait.”

--

Clause (a) of the “Breaking Horses” Regulation provides as follows.

--

“(a)  Any horse which breaks from its gait either at the start or during the running of any race and continues on in a break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.”

Present at the hearing was Mr D. J. Butt the driver of “Toldus” and he represented the connections of that horse.

Mr McIntyre gave evidence and used video coverage to show that “Toldus” broke from its gait after about 150 metres, and continued in a break for about 107 metres.  “Toldus” lost ground in this break.  A short distance further on “Toldus” again broke from its proper gait, and continued in a break for about another 63 metres. Once again “Toldus” lost ground in the break.

Mr Butt agreed with the distances estimated.

The matter was discussed and although it was clear that “Toldus” was in a break for more than 150 metres in total, there were two distinct occasions. We were satisfied that to be in breach of this Rule and the Regulations, the distance of the break must be 150 metres or more, and it must be continuous.

Accordingly we dismissed the protest, and the judge’s placings were confirmed.
