DECISION AND REASONS:
--Following the running of Race 4, the Casino Mobile Pace, an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr K. M. Barron, the driver of Avoir De La (2), alleging a breach of Rule 869(4). The charge was that Mr Barron drove in a manner causing interference to Village Lord (18) over the final stages of the race.
--Although Mr Barron initially denied this breach of the Rules he changed his plea and admitted the breach during the hearing. The evidence in relation to this charge is the same as that given at the hearing of the protest that resulted in Avoir De La being relegated from its first placing.
--Penalty: Mrs Williams said that Mr Barron had a very good driving record and recommended a fine of $200-00. Mr Barron had no comments to make regarding the recommended fine.
--Having heard the submissions on penalty I was satisfied that Mr Barron's guilty plea and good driving record should be taken into account and that a fine of $200-00 was appropriate. Mr Barron was fined the sum of $200-00.
