Following the running of Race 9, Merrin Street Caf? & Bar Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Trainer, Mr G A Johnston, alleging that the hopple shortener cords on VANCE MARIE, trained by Mr Johnston, came adrift with 1400 metres to run and became entangled with the legs of JUDENA resulting in JUDENA breaking and causing interference to several trailing runners.

DECISION AND REASONS:
--Following the running of Race 9, Merrin Street Caf? & Bar Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Trainer, Mr G A Johnston, alleging that the hopple shortener cords on VANCE MARIE, trained by Mr Johnston, came adrift with 1400 metres to run and became entangled with the legs of JUDENA resulting in JUDENA breaking and causing interference to several trailing runners.
----Mr Johnston was present at the hearing of the information and admitted the breach.
----Mrs Williams sought leave to rely on the evidence adduced at the earlier protest hearing. She submitted that the usual fine for a breach of this Rule is $100 but she sought a fine of $200 in this instance because the breach had resulted in interference to another runner or runners in the Race and had resulted in the relegation of VANCE MARIE from 3rd to 6th.
----Mr Johnston admitted that he was "obviously at fault". He believed that he had taken every possible precaution to make sure the gear was in order. He has fitted the same equipment "a thousand times" and it had not happened before.
----Mrs Williams confirmed that Mr Johnston had not previously breached the Rule.
----The Committee delivered the following oral decision:
--"It is clear that this has not happened before at least not in recent times, Mr Johnston, so you are not a person who has offended previously under this particular Rule. I will take that into account. I will also take into account your very frank admission ? you are not seeking to make excuses, you are accepting that the gear was faulty and you are not trying to make excuses for yourself. So, I will take that into account. In terms of the quantum of fine, I accept Mrs Williams' submission that this is slightly different from the average case or the normal case of gear malfunction where it is really only that particular runner that is affected ? where a boring pole comes loose or a hopple ? but in this case the consequences were a little bit more serious than usual and, as you are aware, has resulted in the relegation of your horse from 3rd to 6th in the Race. I feel that some fine greater that the normal one is justified but, taking into account the fact that you have not previously offended and that you were very frank in your admission of the breach, I have decided to impose a fine of $150.00."
