DECISION AND REASONS:
--Following the running of Race 1 an information was lodged by Mr N. G. McIntyre, Stipendiary Steward, against Mr A McPherson, licensed trainer of Gottabeseptember (11), alleging a breach of Rule 865(4). It was alleged that Mr McPherson failed to present Gottabeseptember in the assembly area with a rearing strap, in which it had raced at its previous start at NZMTC on 27th October 2006.
--Mr McPherson had indicated on the Information that he admitted the breach of this rule and he confirmed this at the hearing.
--Mr McPherson explained to the committee that Gottabeseptember had last raced in a standing start event and on that occasion the rearing strap was used. However as this race was a mobile start the use of the rearing strap was not needed. Mr McPherson stated that he did not intend to mislead the public and merely forgot to inform the Stipendiary Stewards of the change.
--Mr McIntyre recommended a fine of $100-00 for this breach. The committee is satisfied that this is an appropriate fine and Mr McPherson is fined the sum of $100-00.
