--Mr O’Reilly had represented to the Stipendiary Stewards that he had the authority of the connections of GALATOS. He had signed an endorsement on the information form “I do not contest the protest”. Mr O’Reilly was not present at the hearing of the information.
--Mr S P Renault, Stipendiary Steward, showed video replays of the relevant part of the Race. He showed GALATOS racing 3-wide without cover leaving the home straight with approximately 1200 metres to run. He also pointed out the respective positions of each of the other four runners referred to in the information. He pointed out GALATOS then break free of interference and come down on CAESAR’S BRACELET who, in turn, checked CRUSADER SPIRIT over the markers. DAZZLING DAWN and PERAKI CHIEF also received interference in the incident. GALATOS settled down and continued in the Race, eventually finishing in 2nd placing, but the other runners suffered varying degrees of interference as a result of which their respective chances were affected, Mr Renault submitted. Mr O’Reilly had made every effort to keep the horse off any other runner. Of the runners interfered with, DAZZLING DAWN finished in 11th placing. Mr Renault sought relegation of GALATOS to 11th placing.
--The Committee was satisfied that GALATOS had clearly interfered with the progress of the other four runners in the Race when it broke from its gait with approximately 1100 metres to run. Having regard to the number of runners interfered, the degree of interference and the effect of the interference on the other runners, the Committee was satisfied that it should exercise its discretion to relegate GALATOS as sought by the Stipendiary Stewards.
--The protest was upheld and GALATOS was relegated from 2nd to 11th placing.
--Consequent upon the relegation, the amended result for the Race is as follows:
1st 4 Cardinal Huff
2nd 15 Sure Swift
3rd 14 Crusader Spirit
4th 8 Peraki Chief
5th 2 Mystical Vision
