DECISION AND REASONS:

Following the running of Race 6, the Ford Baker Real Estate Group Handicap Trot, an information was laid by Stipendiary Steward Mrs K. R. Williams alleging a breach of Rule 870(4) and the "Breaking Horses" Regulations by "Joe Boy" (6) driven by Miss A. Edmonds. Mr P. A. Cowan, the trainer and part owner of Joe Boy, and Miss Edmonds attended this hearing.

Video coverage of the race was used by Stipendiary Steward Mr McIntyre to illustrate that Joe Boy had broken from its gait inside the last 200 metres of the race, and had been in a break for about 70 metres before regaining its proper gait. Mrs Williams said that disqualification of Joe Boy was being sought under Rule 870(4) and the "Breaking Horses" Regulation.

Mr Cowan agreed that he understood the nature of this protest and the Rule and Regulation which applied. Mr Cowan and Miss Edmonds also accepted that Joe Boy had been in a break for more than 50 metres as alleged.

After hearing the relevant evidence from the Stipendiary Stewards and Mr Cowan and Miss Edmonds, and after seeing the video coverage of this incident, I was satisfied that Joe Boy had broken from its gait for 50 metres or more in the final 200 metres of the race and that it should be disqualified. Accordingly Joe Boy was disqualified from its first placing. The amended places are as follows.
