Facts:
Following the running of Race 8, Euroblast Mobile Pace, an information instigating a protest was filed by Chief Stipendiary Steward, Mr NM Ydgren, against READY TO RUMBLE (B N Orange), placed 2nd by the judge, on the ground that it was “in a break over the finish line and was lapped on by EDITORIAL”, placed 3rd by the judge.
Mr Orange, representing the connections of READY TO RUMBLE, had signed the information form indicating that he did not contest the protest. Mr Ydgren confirmed that Mr Orange did not wish to be present at the hearing of the information.
The judge’s placings were as follows:
1st -1 Spondulicks
2nd - 3 Ready to Rumble
3rd - 14 Editorial
4th - 10 Santanna Mach
5th - 6 Bubble Gum
6th - 7 Marrera
The official margins were 2 lengths, head, 1½ lengths, 1¾ lengths.
Rule 870 provides:
(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869A) such relegation of the horse shall be at the discretion of the Judicial Committee.

Mr Ydgren showed a video replay of the final 200 metres of the race. He pointed out READY TO RUMBLE, driven by Mr Orange, clear in the lead, go into a break. He referred to the 100 metres marker on the outside of the track and submitted that READY TO RUMBLE had gone into a gallop at about level with that marker. Prior to the 50 metres marker on the inside of the track, the horse was again pacing, Mr Ydgren said. The horse had, therefore, galloped for less than 50 metres. It galloped again approximately 20 metres short of the finishing line and continued on in a gallop to the finishing line before settling back into a pace, albeit a rough one, just past the line Mr Ydgren submitted.
Mr Ydgren also pointed out that READY TO RUMBLE had been lapped on by EDITORIAL, placed 3rd by the judge. He sought relegation of READY TO RUMBLE to 3rd, behind EDITORIAL.
Reasons for Decision:
The Committee was satisfied that READY TO RUMBLE had gone into a gallop, free of interference, approximately 20 metres from the finishing line and was in a gallop when its nose reached the finishing line. The Committee was further satisfied that it was lapped on by the 3rd placed runner, EDITORIAL, in its correct gait. Finally, the Committee noted that Mr Orange did not contest the relegation of READY TO RUMBLE.
