Facts:

Following the running of Race 3, Hydroflow Distributors Limited Mobile Pace, Information No. 66834 was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Graduation Driver, Mr A K Beecroft, alleging that Mr Beecroft used his whip in an unnecessary manner over the concluding stages while driving COUNT DRACULA.

Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.

Submissions for Decision:

Mr Ydgren showed video replays of the final 400 metres of the race. He pointed out Mr Beecroft, driving COUNT DRACULA, racing at the rear of the field with 400 metres to run. Mr Ydgren alleged that the horse began to lose contact with the field and was tried with the whip by Mr Beecroft. Mr Beecroft continued to use the whip for the “most part of the straight”, Mr Ydgren alleged. Mr Ydgren said that Mr Beecroft was entitled to try the horse but, after the initial two strikes, the use of the whip by Mr Beecroft was unnecessary.

Submissions for Penalty:

Mr Ydgren stated that Mr Beecroft had a clear record under the Rule. He has had 161 lifetime drives and has had 6 drives in the current season. He informed the Committee that a junior horseman had been fined $200 for unnecessary use of the whip on 22 July and he submitted that a fine of that amount was appropriate in this case.

Mr Beecroft, when asked by the Committee, indicated that he would prefer a fine to a suspension.

Reasons for Penalty:

In determining penalty, the Committee took into account Mr Beecroft’s admission of the breach, his previous good record and fines imposed in other cases of unnecessary use of the whip.
