| -- DECISION AND REASONS: --Following the running of Race 7, the CB Richard Ellis Ltd Mobile Pace, an Information was laid by Stipendiary Steward Mrs K. R. Williams alleging a breach of Rule 869(7A)(a), (b) and (c). It was alleged that Mr Hay had allowed his horse "Roland Gaross" to go over 4 to 5 track markers rounding the final bend. --Mr Hay had indicated on the Information that he admitted this breach of the Rules and he confirmed that at the hearing. The evidence given at the protest hearing was accepted as being the basis for this charge. --Penalty --In relation to penalty Mrs Williams advised that Mr Hay had three previous similar convictions since the beginning of this year and that he had been fined varying amounts on those occasions. Mrs Williams also said that Mr Hay's guilty plea and his honesty during the protest hearing should be taken into account and a two day suspension was recommended. ----CHAIRMAN |
