Following the running of Race 7, the CB Richard Ellis Ltd Mobile Pace, an Information was laid by Stipendiary Steward Mrs K. R. Williams alleging a breach of Rule 869(4).
| -- DECISION AND REASONS: --Following the running of Race 7, the CB Richard Ellis Ltd Mobile Pace, an Information was laid by Stipendiary Steward Mrs K. R. Williams alleging a breach of Rule 869(4). It was alleged that Mr Walkinshaw ("Discriminating") had shifted out with approximately 900 metres to run resulting in "The Jet Setter" (R. Sharpe) breaking.". --Mr Walknishaw had indicated on the Information that he admitted this breach of the Rules and he confirmed that at the hearing. The evidence given at the protest hearing was accepted as being the basis for this charge. --Penalty --In relation to penalty Mrs Williams advised that Mr Walkinshaw had one previous relevant conviction when he was fined $200-00. Other than this Mrs Williams said that Mr Walkinshaw had a very good record, and taking this and his guilty plea into account a two day suspension was recommended. --Mr Walkinshaw had no submissions to make as to penalty. --In deciding an appropriate penalty I have taken into account that Mr Walkinshaw has a relatively good driving record and that he admitted the charge. I am satisfied that the penalty suggested is appropriate. --Mr Walkinshaw's horseman's licence will be suspended from the completion of racing on 29 July 2005 until after the completion of racing on 11 August 2005, which is effectively a 2 day suspension. ------ ________________ --CHAIRMAN |
