DECISION AND REASONS:

Following the running of Race 6, the 123racing.com Mobile Pace, Stipendiary Steward Mr N. G. McIntyre laid an Information charging Mr L. K. James with a breach of Rule 859(a)(ii). The Information reads as follows.

"I the above named informant allege that the above named Defendant committed a breach of Rule 859(a)(ii) in that Junior Horseman L. James failed to parade Maybe Russte through the straight prior to going the reverse way."

Rule 859(a)(ii) reads as follows.

"859. A horseman:-

    ------
      --
    1. may drive his horse in its preliminary in either direction provided that:-

    ------
      --
    1. ?..
    2. --
    3. the horse is first paraded through the straight in the correct way of the course ?."

Mr James is a Junior Horseman and he was assisted at the hearing by Mr

M. G. Larter. Mr James had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing.

In explanation for this breach Mr James said that his horse had played up and that her felt it was in the best interests of the horse not to parade in the correct way.

--

In relation to penalty Mr McIntyre said that a senior horseman had recently been fined $100-00 for the same breach. As Mr James was an inexperienced Junior Horseman, and as he had admitted the breach, a fine of $50-00 was recommended.

On behalf of Mr James Mr Larter asked that no fine be imposed. Mr Larter said that Mr James had learnt from the experience and would not make the same mistake again.

--

After hearing submissions on penalty we were not persuaded that this was an appropriate case for no penalty to be imposed. We were also satisfied that the minimal fine of $50-00 recommended was fair and Mr James was fined the sum of $50-00.
