Following the running of Race 6, The Rock ? FM Rock Radio Mobile Pace, an Information was lodged by Chief Stipendiary Steward Mr N. R. Escott instigating a protest against the first placed horse Superkev.
| -- DECISION AND REASONS: --Following the running of Race 6, The Rock ? FM Rock Radio Mobile Pace, an Information was lodged by Chief Stipendiary Steward Mr N. R. Escott instigating a protest against the first placed horse Superkev. This protest was upheld. As a continuation of that hearing Mr Chmiel was charged with careless driving and he admitted a breach of Rule 868(3)(b). --The evidence given at the protest hearing was accepted as being the basis for this charge. In brief Mr Chmiel had moved his horse outwards at about the 200 metre mark causing interference to Shezfullarunnng which broke and lost its chance. --In relation to penalty Mr Escott advised that Mr Chmiel had a good driving record and recommended a fine of $250-00. --Mr Chmiel had no relevant submissions to make relating to penalty, other than to say that he preferred a fine to a suspension. --Having looked at penalties for similar breaches of the rules, and taking into account the guilty plea and Mr Chmiel's good driving record I was satisfied that a fine of $250-00 was appropriate and Mr Chmiel was fined the sum of $250-00. ---- -- --
