Decision:
Following the running of Race 1, the Metalcorp NZ Ltd Handicap Trot, an Information Instigating a Protest was filed by Stipendiary Steward Mr N. M. Ydgren alleging a breach of Rule 869(8). The information reads as follows.
--“This is a protest by horse number (10) placed 6th by the judge against horse number (11) placed 3rd by the judge on the grounds of interference over the final stages.”

--“This is a protest by horse number (10) placed 6th by the judge against horse number (11) placed 3rd by the judge on the grounds of interference over the final stages.”
--Rule 869(8) read as follows.
--“The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
Present at the hearing were Mr A. M. Butt the driver of “Another Moment”, and he advised that he would represent the interests of the trainers and owners. Also present was Mr M. P. Edmonds, the trainer and driver of “Ronnie Coute” who advised that he would represent the interests of the owner of that horse.
Mr Ydgren gave evidence, and used video coverage to illustrate, that in the final stages of the race “Another Moment” had run out and had locked wheels with “Ronnie Coute”, and that had denied that horse a chance to finish in a better placing.
Mr Edmonds gave evidence that “Another Moment” was running out and that Mr Butt was attempting to keep his horse straight. Because of this the sulkies of the respective horses locked wheels, and Mr Edmonds said that he believed he would have finished in 3rd place but for the interference.
--After hearing this evidence Mr Butt was asked if in fact he contested the protest. He advised that he did not. Accordingly “Another Moment” was relegated from 3rd to 6th place, the amended places being as follows.

4th – Coolmaine (7)
