The protest is upheld and 'Mekong Princess' is disqualified from the race.
The amended placings are now 1st – (2) Chevron Express, 2nd – (1) Firenze, 3rd – (3) Arnold, 4th – (10) Mr Good and Evil and 5th (6) Agatha Tyron.

It is ordered that dividends and stakes be paid in accordance with the amended placings.
 

Facts:

Following the running of the Haras Des Trotteurs Mobile Trot, an Information instigating a protest was lodged by Chief Stipendiary Steward, Mr N Ydgren against the fifth placing of 'Mekong Princess' on the grounds that it broke and galloped in excess of 50 metres inside the last 200 metres of the race and was therefore in breach of the Breaking Horses Regulation.

Mr M House, the trainer/driver of 'Mekong Princess', endorsed the information with the words “I do not contest disqualification of Mekong Princess”. Mr House did not wish to be present at the hearing.

Rule 870(3) provides that “any horse which breaks from its gait during a race shall promptly return to its correct gait".

The Breaking Horses Regulations provide: 'that any horse which breaks from its gait and gallops in excess of 50 metres in the last 200 metres of a race shall be in breach of Rule 870(3) and may be disqualified from the race'.

Submissions for Decision:

Mr Ydgren demonstrated the incident by use of the race films and showed where 'Mekong Princess' broke and continued in a gallop for approximately 70 metres.

Mr Ydgren submitted that 'Mekong Princess' was in breach of Rule 870(3) and should be disqualified from the race.

Reasons for Decision:

Mr House admitted the breach of the Rule and did not contest the disqualification of 'Mekong Princess'. The video confirms that the horse galloped in excess of 50 metres in the last 200 metres of the race in breach of the Rule. On Mr House’s admission and on the evidence available the breach is proved and disqualification must follow.
