--DECISION AND REASONS:
Following the running of Race 9, Peninsular Beachfront Resort, Mooloolaba Amateur Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Holder of a Licence to Train, Mr E W Arnold, alleging a breach of Rule 864 (2) (b) in that Mr Arnold, as the trainer of WHY AYE MAN, “produced his horse to race in gear that was not in good condition”.

DECISION AND REASONS:
Following the running of Race 9, Peninsular Beachfront Resort, Mooloolaba Amateur Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Holder of a Licence to Train, Mr E W Arnold, alleging a breach of Rule 864 (2) (b) in that Mr Arnold, as the trainer of WHY AYE MAN, “produced his horse to race in gear that was not in good condition”.
Mr Arnold was present at the hearing of the information and did not admit the breach.
--Rule 864 provides as follows:
(2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-
(b) any gear, appliance or device used or to be used in a race is of good quality and is in good order and condition.
Mr Ydgren informed the Committee that WHY AYE MAN (R A Reekie) left the track approximately 7 minutes before start time of Race 9 with gear hanging off. On being inspected by the Stewards after the Race, it was observed by them that the hopples worn by WHY AYE MAN were not in good enough condition to be worn on raceday. The hopples had broken during the horse’s preliminary. The hopples were produced at the hearing for inspection by the Committee.
Mr Arnold denied that the hopples were not in good condition.
--The hearing was adjourned at Mr Arnold’s request to enable him to speak to Mr Reekie and, if appropriate, call him to give evidence.
--The hearing resumed at the meeting of Rangiora Harness Racing Club at Addington Raceway on 9 June 2009.
--The Stewards informed the Committee that Mr Arnold had spoken to Mr Reekie and, after having done so, he had informed the Stewards that he wished to admit the charge. An amendment had been made to the information form and, on it, Mr Arnold had indicated that he admitted the breach and he had signed the form to this effect. The Stewards informed the Committee that Mr Arnold did not wish to attend the hearing.
--The charge was found proved and Mr Arnold was fined the sum of $100.
