Following the running of Race 8, PGG Wrightson NZ Yearling Sales 2YO Trot, an information was filed by Chief Stipendiary Steward, Mr N R Escott, instigating a protest against RUNNING ON TIME, placed 2nd by the judge, on the grounds of interference to FLAMING ACTION and DE GAULLE with 1500 metres to run.
----Mr E S Inwood, the owner of RUNNING ON TIME, and Trainer/Driver Mr M P Edmonds were present at the hearing of the protest.
----Mr House stated that, just before the 1500 mark, Mr Edmonds' horse broke and veered out abruptly. Mr House stated that he maintained his own line, being several lengths behind Mr Edmonds. Mr Edmonds' horse then came down abruptly meaning that Mr House was then on his back. Mr Edmonds took a hold of his horse at the same time, as Mr House was starting to come out, and it veered out again. Mr House said that he "connected ever so slightly". It was not a deliberate act of interference, he said. DE GAULLE broke as a result of the interference received, lost all chance and was retired from the race.
----Mr Butt said that he was racing a "couple of lengths behind" Mr House. He saw Mr Edmonds' horse gallop and felt that there was room for Mr Edmonds to get to the outside of the track. However, Mr Edmonds remained on the markers and his horse continued in "erratic gallop". The more Mr Edmonds grabbed hold of the horse, the worse the horse appeared to go, Mr Butt said. When RUNNING ON TIME and DE GAULLE broke in front of him, it cost him some 50 metres, according to Mr Butt, when he had to go around them.
----Mrs Williams, Stipendiary Steward, showed video replays of the incident. She pointed out RUNNING ON TIME in the trail, with another runner outside him, break and be restrained by Mr Edmonds. It came out in a gallop, went back down forcing Mr House to restrain DE GAULLE. Still galloping, RUNNING ON TIME ran out again and "shied" on to DE GAULLE, causing it to break and be eventually retired from the race. Mrs Williams also pointed out FLAMING ACTION lose considerable ground as a result of the incident.
----Mr Edmonds admitted that RUNNING ON TIME had galloped. He said that Mr House had just about got past him before galloping. He also acknowledged that Mr Butt's horse had received interference. He explained that he had elected to move back down rather that move out onto DE GAULLE.
----Mr House said that, if his horse had been permitted to trot straight, it would not have broken and would probably run 2nd or 3rd. He was "quite disappointed", he said.
----The Committee was satisfied that there had clearly been interference caused by RUNNING ON TIME to both FLAMING ACTION and DE GAULLE. Furthermore, it was satisfied that the chances of both horses were affected. Having regard to the severity of the interference and the consequences of it - DE GAULLE was put out of the race and FLAMING ACTION lost considerable ground - the Committee was satisfied that it was appropriate to uphold the protest.
----Mr Escott sought disqualification of RUNNING ON TIME and that the Committee ordered that it be disqualified accordingly.
----Consequent upon that disqualification, the amended placings for the race are as follows:
