Following the running of Race 6, the Fraser MacAndrew Ryan Mobile Pace, an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr R. D. Holmes, the driver of ‘Bobs Blue Boy" (9), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively.

DECISION AND REASONS:
--Following the running of Race 6, the Fraser MacAndrew Ryan Mobile Pace, an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr R. D. Holmes, the driver of ‘Bobs Blue Boy" (9), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively.
--Mr Holmes had indicated on the information that he admitted this breach of the Rule and he confirmed this at the hearing. Mr Holmes also confirmed that he understood the Rule and the nature of the charge.
--Mrs Williams gave evidence that Mr Holmes had used his whip between 22 and 24 times in the run home, and this was illustrated by video coverage of the race. Mrs Williams accepted that the whip was not necessarily used on the horse, but that the "Use of the Whip" guidelines made it clear that the rule applies when the whip strikes the horse, harness or sulky.
--Mr Holmes said that he was aware of the guidelines. He also said that he did not hit his horse at all over the concluding stages.
--Penalty:
--In relation to penalty Mrs Williams advised that Mr Holmes had no previous convictions, and a fine of $200-00 was recommended.
--Mr Holmes reiterated that he had not actually hit his horse, but had nothing relevant to say about the fine as recommended.
--In deciding an appropriate penalty I took into account Mr Holmes admission of the breach and the fact that he had no previous convictions for a breach of this Rule. I was also satisfied that this breach was at the lower end of the scale so far as seriousness is concerned, and that a fine of $200-00 was appropriate in the circumstances. Accordingly Mr Holmes was fined the sum of $200-00.
