The meetings intended to be encompassed by the period of suspension are Westport on 4 March, Reefton on 6 March and Timaru HRC at Addington on 10 March 2016.
Facts:
Following the running of Race 4, Clarkson Signs – Vehicle Signage (Junior Drivers) Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Mr T A Quate, alleging that Mr Quate, as the driver of LAYTONS LASS in the race, “drove carelessly in allowing his runner LAYTONS LASS to strike the sulky wheel of JOEMARO (K M Cox) near the 1700 metres”.
Mr Quate was present at the hearing of the information, and he indicated that he admitted the breach. He was assisted at the hearing by Licensed Open Horseman, Mr T S Chmiel.
Rule 869 provides as follows:
(3) No horseman in any race shall drive:-
(b) carelessly.
Mr Ydgren showed video replays of the incident with approximately 700 metres to run. Just prior to that point, Mr Quate had been racing four places back on the markers, immediately behind JOEMARO, driven by Miss Cox. He submitted that Mr Quate did not appear to be having any difficulty with his horse at that point, or prior to that point. He had allowed his horse to improve up onto the back of JOEMARO and make contact with the sulky of that runner, causing his own horse to gallop and lose considerable ground. Mr Ydgren said that the horse had been racing on the bit but, because Mr Quate had his hands too far back down the reins, he had left no margin for error.
Mr Quate said that his horse was having only its second start and was “a wee bit green”, but he conceded that he had his hands too far back on the reins and had no control.
Submissions for Penalty:
Mr Ydgren informed the Committee that Mr Quate has had 24 drives this season, 21 in the 2014/2015 season and 71 career drives in total. He had been fined the sum of $300 by this Committee as recently as 19 February last for a breach of the careless driving Rule for striking a wheel. Mr Ydgren referred to the Penalty Guide which provides for a starting point of a 3 days’ suspension for a second breach of the Rule within 4 months.
Mr Ydgren said that, from the Stewards’ point of view, this was an incident that should not have happened. Having regards to all factors – Mr Quate’s record, his admission of the breach and his Junior Driver status – Mr Ydgren submitted a suspension for 2-3 days would be appropriate. He informed the Committee that the drivers for the Cheviot meeting at Addington on 28 February had been confirmed.
Mr Quate said that he would not be driving at Forbury Park on 3 March, but he was intending to drive at the two West Coast meetings – Westport on 4 March and Reefton on 6 March.
Mr Chmiel said that Mr Quate had to learn from the two charges.

In arriving at penalty, the Committee took the starting point of a 3 days’ suspension in terms of the Penalty Guide. While Mr Quate would normally receive a discount from that starting point for his admission of the breach, the Committee was of the view that anything less than a 3 days’ suspension would be an insufficient penalty. By his own admission, Mr Quate was likely to have only one drive at each of the Westport and Reefton meetings. For that reason, the Committee decided to impose a penalty of a 3 days’ suspension.
