Following the running of Race 10, Millenium Hotel Christchurch Handicap Trot, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Horseman, Mr J P Wheeler, alleging a breach of Rule 869 (2) (a) in that, as the driver of YANKEE NOVA in the Race, he “used his whip excessively in the run home”.



Following the running of Race 10, Millenium Hotel Christchurch Handicap Trot, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Horseman, Mr J P Wheeler, alleging a breach of Rule 869 (2) (a) in that, as the driver of YANKEE NOVA in the Race, he “used his whip excessively in the run home”.

Mr Wheeler had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information.  The charge was found proved accordingly.

Mrs Williams showed a video replay of the final stages of the Race. She pointed out YANKEE NOVA sitting outside the leader approaching the home turn. Mr Wheeler then proceeded to use the whip (on the sulky or dust sheet only) in a rapid motion in excess of 40 times in the run to the finishing line.  Mrs Williams said that it would not look good to the viewing public.

Mrs Williams recommended a fine of $200.

The Committee agreed with Mrs Williams that Mr Wheeler’s use of the whip was clearly excessive notwithstanding that the horse was not struck and, furthermore, that it did not look good.

The Committee took the above factors into account and also took into account Mr Wheeler’s admission of the breach.

Mr Wheeler was fined the sum of $200.
