DECISION AND REASONS:
--Following the running of Race 1, the 123racing.com Handicap Trot, an information was lodged by Stipendiary Steward Mr McIntyre against Mr W. E. Higgs, licensed trainer of Motu Armbro Scott (8), alleging a breach of Rules 865(4). It was alleged that Mr Higgs failed to present Motu Armbro Scott in the assembly area with ear plugs, in which it had raced at its previous start at NZMTC on 17 November 2006.
--Mr Higgs had indicated on the Information that he admitted this breach of the rules and that he did not wish to be present at this hearing.
--Mr McIntyre recommended a fine of $200-00 for this breach as this was a $20,000-00 race. The committee is satisfied that this is was an appropriate fine, and the same amount that Mr B. Purdon was fined for a similar breach on 17 November 2006. Mr Higgs was fined the sum of $200-00.
