DECISION AND REASONS:
--Following the running of Race 7, Roydon Stud Mobile Trot, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Graduation Driver, Mr J D Burgess, alleging a breach of Rule 867 in that Mr Burgess, as the driver of SILVERDALE PRINCE in the Race “drove with his foot out of the sulky footrests for approximately 200 metres in the run home”.

Mr Burgess had signed the Statement by the Defendant endorsed on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Mr Ydgren showed a video replay of the final 200 metres of the Race which clearly showed Mr Burgess’s right foot out of the footrest for approximately the final 200 metres.

Mr Ydgren informed the Committee that Mr Burgess had explained that when he began to get dressed for the race he realised that he had left one boot at home so he had to wear some old ones.
----
Mr Burgess was fined the sum of $100.
