Following the running of Race 6, Dr Corin Murfitt & Associates Mobile Pace, an information was filed by  Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Mr A E Veint, alleging a breach of Rule 869 (3) (b)  in that Mr Veint, as the driver of TARA SAHARA , “drove carelessly when allowing TARA SAHARA to strike the sulky wheel of INEVITABLE causing his horse to break and lose all chance”.

Following the running of Race 6, Dr Corin Murfitt & Associates Mobile Pace, an information was filed by  Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Mr A E Veint, alleging a breach of Rule 869 (3) (b)  in that Mr Veint, as the driver of TARA SAHARA , “drove carelessly when allowing TARA SAHARA to strike the sulky wheel of INEVITABLE causing his horse to break and lose all chance”.

Mr Veint was present at the hearing of the information. He advised that he waived the right to be assisted by a Senior Horseman in relation the charge and that he admitted the breach.

The breach was found proved accordingly.

Mr Ydgren showed a video replay of the final 200-300 metres of the Race. He pointed out TARA SAHARA 3-back on the markers approaching the home turn, following INEVITABLE (A M Butt). Shortly after, Mr Veint shifted out on to the wheel of INEVITABLE and struck the sulky wheel of that runner. This happened as Mr Veint reached down to activate the removeable hood on the horse. Mr Ydgren said that, when Mr Veint took his hands off the rein, the horse, which was travelling well, lunged, hit the wheel and galloped and lost its chance. INEVITABLE suffered a punctured tyre as a result.

Mr Ydgren informed the Committee that Mr Veint had been fined $200 for careless driving at Rangiora on 9 June 2009. Because this was Mr Veint’s second breach in such a short time, Mr Ydgren recommended a fine of $400-500. He submitted a deterrent penalty was necessary. Mr Veint has had 450 career drives for 18 wins. This season he has had 222 drives.

Mr Veint had no submissions to make in relation to penalty.

The Committee took into account Mr Veint’s admission of the breach. It also took into account Mr Veint’s recent  breach of the careless driving Rule. A deterrent penalty was called for. The Committee was aware of Mr Veint’s junior driver status and that his income was likely to be limited and took this into account in deciding the penalty.

Mr Veint was fined the sum of $350.
