Facts:
Following the running of Race 6, ADT Armourguard Handicap Pace, an information was filed by Stipendiary Steward, Mr S W Wallis, against Licensed Public Trainer, Mr R J Dunn, alleging a breach of Rule 849 (2) in that Mr Dunn “presented SAMUEL JAMES to race with number 2 attached to the harness and JOSHUA MAC with number 4 attached to the harness.”
Mr Dunn was present at the hearing of the information and he indicated that the breach was admitted.
Rule 849 provides as follows:
(2) The trainer, horseman or person in control of each horse in the race shall ensure that the proper numbered saddlecloth is attached prior to the horse parading in the assembly area.
Submissions for Decision:
The Committee noted that, according to the official race card, SAMUEL JAMES was to carry saddlecloth No. 1 and JOSHUA MAC saddlecloth No. 5. Mr Dunn’s two other runners in the Race were PIPER HEIDSIECK (No. 2) and MACH BANNER (No. 4).
Mr Wallis explained to the Committee that a breach of the Rule was one provided for under the Minor Infringement System. However, he said, there were circumstances which the Stewards wished the Committee to take into account in this case. Mr Wallis said the Stewards could have elected to complete two minor infringement notices (one in respect of each horse). He wished the Committee to consider that Mr Dunn had four runners in Race 6. He submitted that the Committee should consider the two breaches as being one offence.
Mr Dunn supported that submission of Mr Wallis. He also pointed out that the horses did not get as far as going onto the track before the error was detected.

Reasons for Penalty:
The Committee had regard to the fact that Mr Dunn had saddled four runners in the Race. This was a compelling mitigating factor as the Committee appreciated how easy it would be, in those circumstances, to make an error given the pressures of race night. The Committee accepted that, technically, there were two separate breaches of the Rule but was prepared to regard it as being one offence. The breach was mitigated by the fact that the error was detected at an early stage, before either horse made it onto the track.
