Following the running of Race 2, the Christian Cullen Mobile Pace, an information was laid by Stipendiary Steward Mr N. M. Ydgren under Rule 869(6)(b) and (c) alleging a breach of the push out rule by Mr P. J. Davis, the driver of “Torbrae” (16), with just under 1200 metres to run.
DECISION AND REASONS:
--Following the running of Race 2, the Christian Cullen Mobile Pace, an information was laid by Stipendiary Steward Mr N. M. Ydgren under Rule 869(6)(b) and (c) alleging a breach of the push out rule by Mr P. J. Davis, the driver of “Torbrae” (16), with just under 1200 metres to run.

Mr Davis had indicated on the Information that he admitted this breach of the Rules and he confirmed this at the hearing. Mr Davis also agreed that he understood the charge and the Rule it was brought under.

Stipendiary Steward Mr S. Renault used video coverage to illustrate that “Broady” (6) had been pushed wider on the track as alleged in the Information.
----
Mr Davis explained that “Torbrae” seemed not to be breathing very well at the time of this incident, and it also “got keen”.

PENALTY:
--Mr Ydgren advised that the Mr Davis had no previous relevant convictions and a fine of $200-00 was recommended. Mr Davis had no submissions to make regarding penalty.

I was satisfied that a fine of $200-00 was appropriate in this case, and Mr Davis was fined this amount.
