The protest is upheld and Doff your Cap is disqualified from the race.

Doff Your Cap finished 5th in the race. Carlton, who is also disqualified from the same race for the same breach, finished 6th. There were only six starters. Accordingly, the first four placings remain as they were past the post.

Facts:

Following the running of the Haras Des Trotteurs 2YO Mobile Trot, an information instigating a protest was lodged by Stipendiary Steward Mr S Renault against the fifth placing of Doff Your Cap on the grounds that it broke and galloped in excess of 50 metres inside the last 200 metres of the race and was therefore in breach of the Breaking Horses Regulation.

The protest was uncontested, disqualification accepted and Mr Jones confirmed to Mr Renault that he would not appear at this hearing.

Rule 870(3) provides that “any horse which breaks from its gait during a race shall promptly return to its correct gait."

The Breaking Horses Regulations provide "that any horse which breaks from its gait and gallops in excess of 50 metres in the last 200 metres of a race shall be in breach of Rule 870(3) and may be disqualified from the race."

Submissions for Decision:

Mr Renault replayed the race video and showed Doff Your Cap break and gallop for approximately 120 metres during the final 200 metres of the race.

Mr Renault submitted that Doff Your Cap was in breach of Rule 870(3) and should be disqualified from the race.

Reasons for Decision:

The Committee is satisfied that Doff Your Cap broke and galloped in excess of 50 metres inside the last 200 metres of the race and was therefore in breach of the Breaking Horses Regulation.
