Ms O’Reilly admitted the charge. It was clear to the committee on the video evidence that the charge was made out in any event. The charge was proved.

Penalty:

Ms O’Reilly will be suspended for four days. Deferment is granted in order for her to drive on 2 March 2018. She will be suspended effective after that date on 4, 8, 9 and 11 March 2018 being calendar racing dates.

Facts:

Ms O’Reilly is charged with careless driving. She is alleged to have caused her horse, near the 200 metres mark, and in tight racing to move outwards before striking the wheel of Garry’s Legacy, breaking and losing all chance in the race.

Ms O’Reilly admitted the breach.

Mr Renault replayed the incident using the video footage.

Submissions for Penalty:

Mr Renault submitted that Ms O’Reilly was a promising junior driver. This was low level carelessness in his submission borne out of inexperience. However, this breach was her third breach for careless driving in three months. Having regard to the Guidelines Mr Renault submitted the starting point was a fine of three days, which ought to be uplifted by one day having regard to Ms O’Reilly’s record and the consequences of her actions for connections of her drive. Ms O’Reilly sought a deferment so she could drive at Addington on 2 March 2018.

Mr Dunn accepted Mr Renault’s submissions as reasonable and fair. Ms O’Reilly explained that her horse was keen to get out and challenge for the race. She accepted she did not have clear room to do so and would learn from the incident.

Reasons for Penalty:

The committee considers this to be a clear case of careless driving. It is low to medium level carelessness, which caused her drive to break and lose its chance when “keen”.
